Artificial Intelligence Technology in the Context of International Humanitarian Law

ABSTRACT:

This paper examines the growing framework for the use of artificial intelligence (AI) technologies in armed conflicts and military confrontations, particularly due to their impact in areas such as autonomous (lethal) weapons systems, surveillance and reconnaissance operations, cyber warfare, and logistical support. The study analyzes these developments in light of the fundamental principles of international humanitarian law (IHL) and the challenges AI poses to the principle of distinction, the principle of proportionality, the principle of military necessity, and the principle of humanity in IHL. The research also addresses the issue of international responsibility for violations of IHL committed through the use of AI technologies, whether in the form of state responsibility or individual criminal responsibility.
