Research On the Terminal Cancer Patient Removes Vital Device

ABSTRACT:

The Possibility of the Constitutionality of Euthanasia in Taiwan. This article emphasizes the importance of respecting patients’ autonomy and human dignity, while also pointing out the potential conflict between these values and the constitutional protection of the right to life. It discusses how to prioritize between the right to life and the right to autonomy. The paper proposes a solution based on palliative and hospice care, suggesting that corresponding legislation be enacted to establish systems such as advance directives and palliative care, in order to safeguard the constitutional core values of the right to life, human dignity, and autonomy. At present, Taiwan only permits voluntary passive euthanasia. However, existing laws and regulations have not yet fully ensured every individual’s right to die, especially in terms of defining the value of life. Therefore, this paper hopes that future developments will improve Taiwan’s euthanasia system from the perspective of patients’ autonomy.
