Acquis Communautaire Problematic Chapter in Albanian Progress

ABSTRACT:
Albania wants to join the European Union and in the process of its membership some of the Chapters of the acquis communautaire are more problematic and challenging. Chapter 23, Justice and Human Rights, is one of the most problematic issues mainly in practical rather than legislative terms. Albania has formally opened 33 negotiating chapters and due to difficulties in the implementation of judicial and institutional mechanisms in accordance with European Union standards and methodology. This study aims to identify the elements that hinder the full functioning of the justice system and the reasons why obstacles appear in the full approximation of this chapter. Focusing on the progress of the European Commission’s reports, problems with judicial reform, vetting, political influence and lack of administrative capacities, it is intended to bring a complete backlog of problems and delays in the approximation of this chapter. Problems that must be solved before its complete closure as this chapter constitutes the basis for the rule of law, the rule of law and transparency.
