The Role of Administrative and Civil Law Reforms in Enhancing Legal Certainty for Small Businesses: Lessons from Algeria

ABSTRACT:

Small and medium-sized enterprises (SMEs) represent an essential driver of sustainable economic development in emerging economies. In Algeria, the growth of SMEs remains closely tied to the efficiency and transparency of the legal framework, particularly administrative and civil law. This paper investigates how reforms in these two areas can enhance legal certainty, reduce bureaucratic burdens, and improve access to justice for entrepreneurs. Using a qualitative approach, including document analysis and case studies, the research highlights challenges such as lengthy administrative procedures, unclear contract enforcement, and limited legal support mechanisms. Comparative insights from international best practices are provided to demonstrate how streamlined administrative law and strengthened civil law mechanisms contribute to a more predictable and business-friendly environment. Based on these findings, the paper proposes a reform-oriented legal model that emphasizes simplified registration, digitalized notarial services, and alternative dispute resolution tools. The study concludes that a stronger integration between administrative and civil law reforms is essential for empowering SMEs, fostering entrepreneurship, and ensuring long-term socio-economic development in Algeria.
