Assessing The Role of The Social Movement in Fighting Against Eviction of The Marginalised Population In South Africa: Case Study On Northern Kwazulu-Natal Province

ABSTRACT:

This paper outlines the occurrences of evictions of marginalised population in South Africa democratic state. It also outlines root causes of eviction and its continuation under a democratic dispensation government since 1994 and how a Social Movement such as a Landless People’s Movement (LPM), Farm and Rural Workers Support Association (FRWSA), Farm-Dwellers’ Eviction and Development Committee (FEDCO) have responded on fighting against eviction of the marginalised population. On the other side this paper will outline the rule of law, use of the constitution and human right in South Africa in protecting all citizens especial the marginalised population. Again, it where this paper exploring on a role of government in assisting those who are living under margins, landless and living under tenure in South Africa. Hence a study will examining an existence of South African democracy and its effectiveness by assessing an South African Human Rights Commission especial on Commission of Enquiry on the violation of farm-dwellers in the farming areas of South Africa. It where a study will look on the recommendations of an Enquiry and how those recommendations has contributed in ending the eviction of the marginalised population in South Africa. Again, it will outline why the issue of eviction continuing taking place under a new democratic government well known as a progressive government with a progression legislations. Then, after that it when a broader picture of democracy, human rights, social movement, marginalised population, evictions, and constitutional democracy will be broad in under new South African democratic government era and its milestone since from 1994.
