The Psychological Process of Reintegration and Identity Reconstruction in Preventing Recidivism: A Psycho-Legal Approach

ABSTRACT:

Recidivism remains one of the most persistent challenges facing contemporary criminal justice systems, highlighting the need for approaches that extend beyond punishment and emphasize rehabilitation and successful social reintegration. This paper examines the psychological process of reintegration and identity reconstruction as essential components in preventing reoffending, adopting an interdisciplinary psycho-legal perspective. The study explores how cognitive, emotional, and social factors influence an offender’s transition from a criminal identity toward a prosocial identity that supports lawful behavior and long-term community reintegration. Particular attention is given to the role of self-perception, motivation for change, resilience, social support, and therapeutic interventions in facilitating identity transformation following incarceration. From a legal standpoint, the paper analyzes the importance of rehabilitation-oriented criminal justice policies, probation services, restorative justice practices, and post-release support mechanisms in promoting desistance from crime. It also examines international human rights standards that recognize the rehabilitation and social reintegration of offenders as fundamental objectives of the penal system. By integrating findings from psychology, criminology and criminal law, the study demonstrates that sustainable reductions in recidivism depend not only on legal sanctions but also on addressing the psychological processes underlying behavioral change. The paper argues that effective reintegration requires coordinated efforts involving correctional institutions, mental health professionals, probation authorities, and community organizations. Strengthening psycho-legal rehabilitation programs, individualized intervention strategies and evidence-based reintegration policies may significantly reduce recidivism while enhancing public safety and protecting the fundamental rights and dignity of former offenders. Ultimately, successful identity reconstruction represents a critical pathway toward lasting behavioral change and social inclusion.
