The Role of The Case Law of The Court of Justice of The European Union in Harmonizing the Criminal Treatment of Human Trafficking

ABSTRACT:
This study examines the role of the case law of the Court of Justice of the European Union (CJEU) in fostering the harmonization of the criminal treatment of human trafficking within the European legal order. While the substantive definition of trafficking in human beings has been progressively aligned through instruments such as Directive 2011/36/EU, divergences persist in the interpretation and application of criminal provisions at national level. In this context, the CJEU performs a pivotal integrative function by ensuring the uniform interpretation of EU law and by clarifying the scope of Member States’ obligations in the fields of criminalization, victim protection, and procedural guarantees.
The article analyses relevant CJEU jurisprudence concerning the principles of effectiveness, proportionality, mutual recognition, and sincere cooperation, demonstrating how these doctrinal tools contribute indirectly to the consolidation of a coherent criminal policy against trafficking. Particular attention is paid to the Court’s interpretative methodology, including autonomous interpretation of EU concepts and the teleological approach, which strengthens the uniform application of anti-trafficking norms across diverse national systems.
The research argues that, although criminal law remains largely within the competence of Member States, the jurisprudential intervention of the CJEU has significantly reduced normative fragmentation and enhanced legal certainty. By articulating binding interpretative standards and reinforcing fundamental rights considerations, the Court has shaped a convergent framework for combating human trafficking. Ultimately, the study highlights the dynamic interplay between supranational judicial authority and national criminal justice systems in the construction of a harmonized European response to trafficking in human beings.
