The Right to Create Vs. The Right to Privacy: A Critical Examination of Allusion Novels and Personal Rights in Artistic Expression

ABSTRACT:
The novel, as a pivotal form of artistic expression, frequently provokes legal and ethical debates regarding the balance between creative autonomy and personal rights. This paper examines the tension between an author’s freedom to create and an individual’s right to privacy, focusing particularly on allusion novels. These works, often rooted in real events and individuals, blur the boundary between fiction and reality. In light of this, the paper draws on legal precedents and ethical considerations to assess the risks associated with such portrayals. Ultimately, recommendations are proposed to reconcile creative expression with the protection of individual privacy, thereby ensuring that both are respected.
