ABSTRACT:

This research paper delves into a comprehensive study of children’s rights under Wadima’s Law, offering a comparative analysis between Islamic jurisprudence and the federal law of the United Arab Emirates (UAE). The study is driven by the necessity to understand and safeguard children’s rights, a topic of profound scientific, theoretical, and practical significance. The theoretical aspect focuses on employing Wadima’s Law as a lens to explore the fundamental rights of children as recognized in UAE law and Islamic jurisprudence. The practical aspect underscores the urgent need to protect the rights of children – a group often unable to advocate for themselves – ensuring their treatment with compassion and justice. The paper is structured into four critical chapters, each addressing distinct rights of children as outlined in both legal systems: Essential and family rights, Health and social rights, Cultural and educational rights, and the Right to protection, including its mechanisms, measures, and penalties. This structured approach allows for a thorough exploration of the various dimensions of children’s rights. One of the pivotal findings of this study is the diligent effort of UAE law in the protection and promotion of children’s rights, reflecting a commitment that aligns closely with the principles outlined in Islamic jurisprudence. This research not only provides an academic comparison of children’s rights in two legal frameworks but also highlights the practical implications of these laws in safeguarding the welfare and rights of children in the UAE.
