Legal mechanisms to limit the social impact of domestic violence in Romania
The present paper is part of the research steps I am conducting in the framework of my doctoral thesis on the topic of combating domestic violence through criminal law means, focusing mainly on the impact of criminal law instruments on victims’ safety. The latter is an important social issue, especially in the current context of long stays at home, which, together with relatively more difficult access to justice, has led to an escalation of domestic violence worldwide. Specifically, I will briefly address the presentation of the current legal framework, addressing the elements of criminal legislation and highlighting the weaknesses in terms of ensuring the safety of the person or suggesting ways to harmonize and improve the legal framework. The conclusions of the study will present the neuralgic points of the criminal legislation in relation to the protection of the life and integrity of the victims of domestic violence, as well as the changes that I consider appropriate to improve the legal measures in this area.
