Rights to Education: Free Access for Orphaned and Vulnerable Children in Indonesia

For the past three years, the number of drop-outs students in different education levels such as primary school, junior secondary school, general senior secondary school, and vocational senior secondary school in Indonesia reveals significant up and down graphs on average. However, the data shows the same trend from the academic year 2016/2017 to 2018/2019, namely that the academic year 2018/2019 reaches the highest number of drop-outs students for each education level, according to the Ministry of Education and Culture of Republic Indonesia data. In other words, there are in total of 301.124 drop-outs students in the academic year 2018/2019. The Indonesia Central Bureau of Statistics found that educational parent’s background and family financial issues are the two external grounds factors causing drop-outs situation among students. Meanwhile, the orphaned children and vulnerable children are the two inseparable children groups which well-known as the most (potential) marginalized groups among the society to access education properly. Thus, this article attempts to elaborate on the children’s rights to education based on the human rights approach in Indonesia and then propose an idea to drop the high number of drop-outs students among those specific groups of children. The methodology being used in this article is that the research-desk.
